By accessing or using Vaguely (vaguely.app) and any related applications (the 'Service'), operated by Vaguely, Ontario, Canada, you agree to be bound by these Terms of Service ('Terms'). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Vaguely.
You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.
You may use certain features without an account. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised use at info@vaguely.app.

The Service, including its design, code, branding, and the original selection and arrangement of search results, is owned by Vaguely and protected by applicable intellectual property laws. Search results may contain or reference content owned by third parties; we do not claim ownership of such underlying content. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.
By submitting search queries, confirmed identifications, or other content through the Service, you grant us a worldwide, royalty-free licence to use, reproduce, and display that content for as long as reasonably necessary to operate and improve the Service. You represent that you have the right to submit such content.
Certain features require a paid subscription. Mobile app subscriptions are billed through Apple App Store or Google Play and are subject to their respective terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. No refunds will be issued for partial subscription periods except as required by applicable law. For users in Ontario, Canada, your statutory rights under the Consumer Protection Act are not affected by this provision.
The Service is provided 'as is' and 'as available' without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that search results will be accurate or complete.
To the fullest extent permitted by law, Vaguely shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claim shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $100 CAD. For users in the European Union, nothing in these Terms limits your rights under applicable EU consumer protection laws.
You agree to indemnify, defend, and hold harmless Vaguely and its operators, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your licence to use the Service ceases immediately.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. For users in the European Union, nothing in these Terms limits your rights under applicable EU consumer protection or data protection laws.
We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a new effective date. For existing users, material changes will take effect no sooner than 14 days after notice is posted. Continued use of the Service following the effective date constitutes acceptance of the revised Terms.
